All owners and controllers in charge of managing, or maintaining the dwellings, grounds and structures are potential defendants in a tort lawsuit for recovery of economic and non economic damages. The provides that anyone who played a role in causing or creating the calamity may be held accountable under California statue and negligence law by the filing of a lawsuit (See Fill-able CA Courts Complaint.) The negligence at issue can rear its ugly head in a variety of forms when it involves property, and it is the duty of the property owner to ensure their structures are safely maintained and inspected for dangers and maintenance. A Slip and Serious Fall is a Common Premises Claim
Premises liability can occur when a floor is too slippery or when a building has loose materials that cause a hazard by blocking a waking path, which prevents a person from safely navigating through the building.
Other unforeseen, yet none the less tragic events can be caused due to exits or ramps that are not in place. Common scenarios include being run over by warehouse equipment, like forklifts and floor-jacks. Other cases include being hurt on a job site, or at work.
Building owners are responsible for providing safe walkways leading to their property and this includes when there are weather conditions that can make the walkway dangerous. The building owner does not control the weather, but weather conditions can play a role in accidents. Other problems that can cause property accidents is uneven pavement, uneven or unsecured flooring or carpeting, which can be a cause of a person tripping and sustaining injuries.
What If I Am Hurt?
When a person is injured on the property the owner can be held liable and their insurance company either pays up, or a lawyer sues with a premises lawsuit. The costs of medical bills, loss of income and other damages should be covered by the property owners insurance and when it is not the owner can be held liable.
